Beth... Sounds like he wants all the benefits without the risks and expenses, but I'll leave that to the shrinks and focus on the tax parts.

First of all, filing married/separate rarely saves you money (taxes) so both of you are probably paying more in taxes than if you filed jointly. Also, filing jointly does not necessarily give him any rights to property or investments that may be yours (there may be some community property laws that govern depending on where you live). The challenge filing jointly given this situation is figuring out each others tax liabilities so one doesn't benefit from the other's situation. While you can do this with TurboTax, it may be more work than many may want to do.

So, with all this said, I would encourage you to file jointly simply to save on taxes. However, if that is not your primary concern, then filing married/separate will keep everything separate and ensure everyone pays their own fair share of their taxes.

Thanks for a good question!

I bought a home a few years ago, and lived there with my boyfriend until we got married last October. The mortgage is only in my name, and he has not helped to pay for some expensive repairs and improvements. (He has helped to do some repairs though). I refinanced a year ago and he still did not want to be on the mortgage, which is fine. This year wants to file married/jointly so he can benefit from the home ownership status. It sounds selfish, but I feel like he's not yet 'earned' the right to say he has a financial stake in the home. I would rather file married/separate, mostly because I think it gets too complicated mixing both of our investments & finances together. I have used Turbo Tax the last few years and really like the ease of it. Does he have a right to claim ownership in regards to taxes?

Thanks!
